POSITIVE NEWS FOUNDATION TERMS OF USE
Welcome! We’re happy to have you here, and hope you find our shared news delightful to read. These Terms of Use (“Terms”) apply to your use of the Positive News Foundation (“PNF”, “we”, “us”, “our”, in Dutch: Stichting Positive News) websites, products, and services. Please read these Terms carefully which contain important information about your relationship with the PNF, including the mandatory arbitration of disputes between us, instead of class actions or jury trials; by using the PNF’s websites and applications, you agree to be bound by them. The PNF curates the best experience for its users, including presenting content on our websites and apps that PNF believes you may be interested in based on the content that you have read, clicked on, or otherwise interacted with. Please see our privacy policy for more information about how we collect and use your information.
CONTENT
Content on the PNF’s websites and applications may be protected by one or more laws regarding intellectual property:
PNF’s Service, Products, and Brand
The PNF grants you a personal, worldwide, non-assignable license to use the PNF services we provide you for your own personal, non-commercial use. This license lets you use PNF solely as permitted by these Terms. Unauthorized use of any of PNF’s trademarks, logos, domain names, or other distinctive brand features is prohibited.
Service Use Guidelines
You will use the service only for lawful purposes, and will not violate the rights of third parties. Any unacceptable use, including posting or collecting content that is obscene, pornographic, gory, illegal, threatening or harassing, excessively violent or promoting the harm of self or others, may result in immediate suspension of service access in the future.
Your Content
You can submit (your own) content to the PNF, including articles, photos, comments, and other content. By submitting, you give us permission to use your content to do what we reasonably believe necessary to provide our service both now and in the future including storing, displaying, reproducing, and distributing your submitted content. This might also include promoting your content with partner companies or services for broader broadcast, distribution, or publication via the PNF websites and applications. We may not pre-screen everyone’s content.
You agree not to commercially exploit the PNF use it to:
(a) upload, transmit, or distribute any computer viruses, worms, or any software intended to damage or alter a computer system or data;
(b) send unsolicited or unauthorized advertising, promotional materials, junk mail, spam, chain letters, pyramid schemes, or any other form of duplicative or unsolicited messages, whether commercial or otherwise;
(c) harvest, collect, gather or assemble information or data regarding other users, including e-mail addresses, without their consent;
(d) interfere with or disrupt servers or networks connected to PNF or violate the regulations, policies, or procedures of such networks;
(e) attempt to gain unauthorized access to PNF, other computer systems or networks connected to or used together with PNF, through password mining or other means; or
(f) harass or interfere with another user’s use and enjoyment of PNF.
THIRD-PARTY SITES AND PRODUCTS
We assume no liability for anything that anyone publishes on articles linked to by the PNF. The PNF’s websites and applications contain links to websites, services, content, and products that we don’t own or control (collectively, “Third Party Sites”). The PNF provides links to these Third Party Sites only as a convenience and does not review, approve, monitor, endorse, warrant, or make any representations with respect to Third-Party Sites, including as to any content or accessibility of content on Third Party Sites, and we assume no responsibility for such Third Party Sites, third-party content, or products purchased through Third Party Sites. You agree that you use all Third-Party Sites at your own risk. When you link to a Third Party Site, the applicable service provider’s terms and policies, including privacy and data gathering practices govern. You should make whatever investigation you feel necessary or appropriate before proceeding with any transaction with any Third Party Site.
PRIVACY
Our Privacy Policy and Cookie Statement explain our collection and use of information on the service, including information you may consider personal.
SECURITY
We take the security of the PNF websites and applications very seriously. We use reasonable practices to protect the security of our websites and applications, but we cannot guarantee that someone won’t be able to defeat our security measures. Please let us know immediately if you discover any compromise. We are always on the lookout for security loopholes in the PNF’s websites and applications. If you discover a vulnerability in our service, we would be grateful for your report and encourage you to let us know immediately. NO KIDS
We love kids as much as anyone, but the PNF’s websites and applications is only for people 18 years old and older. If we learn a child under 18 is using our service, we will terminate the child’s account.
COPYRIGHT

CHANGES TO OUR SERVICE
PNF has a dynamic product, always evolving and (hopefully) getting better. As a result, we may change, eliminate or restrict access to our products or any part of our service at any time, for any reason, with or without advance notice. And we may do so with respect to one, some, or all of our users.
DISCLAIMERS
The PNF’s websites and applications are provided “as is” without any warranties, express or implied. PNF disclaims all warranties and conditions of merchantability, fitness for a particular purpose, and non-infringement.
LIMITATION OF LIABILITY
To the fullest extent allowed by law, the PNF shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly or any loss of data, use, goodwill, or other intangible losses resulting from
(a) your access to, use of, inability to access, or inability to use the PNF websites or applications;
(b) any third party conduct or content on the PNF websites or applications, including any defamatory, offensive, or illegal conduct of third parties; or
(c) any unauthorized access, use, or alteration of third-party content. The maximum liability of the PNF to you for our services is $100.
ARBITRATION
If you have a dispute with the PNF for any reason, we’d like the opportunity to work out our differences informally. We strongly encourage you to email legal@positivenewsfoundation.org and we’ll do our best to resolve the dispute in good faith. We’re reasonable people, really. If we aren’t able to solve the problem that way, we both agree that we will resolve any claims arising from these Terms or the PNF service by final and binding arbitration through the Dutch Arbitration Association (“DAA”). The arbitration will take place in The Hague, The Netherlands. Either of us may file a lawsuit in court solely for injunctive relief against the other to stop misuse of the PNF or intellectual property infringement without first going through arbitration. You agree to resolve any dispute you have with us on an individual basis in arbitration, and not as a class arbitration, class action, or consolidated proceeding of any kind.
GOVERNING LAW AND JURISDICTION
These Terms will be governed by the laws of the Netherlands, except for its conflict of laws principles. For claims that aren’t subject to arbitration, we each agree that any such claims shall be litigated exclusively in a state court located in The Hague, The Netherlands, and you consent to personal jurisdiction in those courts.
ENTIRE AGREEMENT
These Terms and our Privacy Policy constitute the entire agreement between you and the Positive News Foundation. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue to be in full force and effect. Our failure to exercise or enforce any right or provision of these Terms shall not operate as a waiver of such right or provision.
MODIFICATION
These Terms of Use may be modified from time to time. The date of the most recent revisions will always be at https://positivenewsfoundation.org/terms, and older versions are available upon request. If we make changes that we believe will substantially alter your rights, we will notify you by posting a notice on our websites. You agree to accept any changes or revisions to these Terms by continuing to use PNF’s services.
